Terms of service

These terms are an agreement between you (the business using Rumidza) and Next Foundry Enterprise (Pvt) Ltd (“Rumidza”, “we”). By creating an account you accept them.

1. The service

Rumidza provides AI replies to customer messages and comments, lead management, email outreach, social media posting and growth tools, and AI-generated images and videos (“Studio”). Features depend on your plan.

2. Your account

• You must be at least 18 and authorised to act for the business.
• Keep your password safe. You are responsible for activity on your account, including by users you invite.
• Give accurate business information. The AI replies using what you provide, so keep prices and details up to date.

3. Plans, payment and cancellation

• Plans are billed monthly in advance, in US dollars unless stated otherwise. Prices are shown on our pricing section.
• Plan credits reset each month and do not roll over. Credits you buy (top-ups and video packs) are used after your plan credits and do not expire while your account is open. They cannot be exchanged for cash.
• New businesses get a 14-day free trial. AI replies and Studio pause when the trial or a paid month ends, until you pay.
• Done-for-you videos are delivered within 2 working days of payment and include one round of changes.
• The optional setup service is a one-off fee and is not refundable once the work has started.
• You can cancel at any time. You keep access until the end of the paid month. We do not refund part months.
• If payment fails, we may pause the service after giving notice.

4. Acceptable use

You agree not to use Rumidza to:

• send spam, or message or email people in breach of anti-spam or data protection laws (including POPIA and Zimbabwe’s Cyber and Data Protection Act);
• break the rules of Meta (WhatsApp, Facebook, Instagram), Google, Microsoft or other connected platforms;
• sell or promote illegal goods or services, or mislead customers about prices, products or terms;
• create images or videos of real people without their permission, impersonate anyone, or use other companies’ characters, logos or trademarks;
• create sexual, hateful, violent or harassing content, or content aimed at children;
• attempt to break, overload or reverse-engineer the service.

We may suspend accounts that break these rules, and remove content that does.

4a. Websites hosted by Rumidza

• You are responsible for everything on your Rumidza website: products, prices, photos and claims must be true and yours to use.
• Websites are checked automatically before they go live and can be reported by the public. We may pause any website that breaks these terms, without notice where there is risk to the public.
• Your website stays online while your plan is active, and for 30 days after it ends. Free addresses (yourname.rumidza.site) may be reassigned if a website is deleted or unused for 6 months.
• If you connect your own domain, you remain the owner of the domain and pay for it with your domain company.

5. AI-generated content

• AI can make mistakes. You are responsible for the replies, posts, emails and media sent from your accounts. You can review, edit or turn off automatic replies at any time.
• Where the law or a platform requires it, you must label realistic AI-generated people or scenes in adverts as AI-generated.
• Subject to these terms, the content you create in Rumidza is yours to use. Similar content may be produced for other users, so we cannot guarantee it is unique.

6. Your data

You own your business data and your customers’ data. You allow us to process it only to provide the service, as described in our privacy policy. For your contacts’ personal information you are the responsible party, and we act on your instructions.

7. Third-party platforms

Rumidza depends on services we do not control, such as WhatsApp, Facebook, Instagram, Gmail and Outlook. If they change their rules or limit access, some features may change or stop. We are not responsible for actions those platforms take against your accounts.

8. Availability and changes

We work to keep Rumidza available but do not promise it will be uninterrupted or error-free. We may improve or change features. If a change removes something important from your plan, we will tell you in advance.

9. Liability

To the extent the law allows, Rumidza is not liable for lost profits, lost sales or indirect losses, and our total liability for any claim is limited to the fees you paid in the 3 months before the claim. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.

10. Ending the agreement

You can close your account at any time by emailing us. We may end this agreement with 30 days’ notice, or immediately for serious breach. After closure, data is deleted as described in the privacy policy.

11. Governing law

These terms are governed by the laws of [Zimbabwe / South Africa], and disputes will be heard in its courts.
